By accessing or using Volution ("Service"), operated by Sintetico Inc. ("Company", "we", "us", or "our") at volution.app, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

These terms constitute a legally binding agreement between you and Sintetico Inc. regarding your use of the Service.

3. Engagement & Payment

Discovery Call

Initial strategy assessments are provided at no cost. These calls are designed to evaluate fit and are not a commitment to engage our services.

Service Engagement

Upon mutual agreement to proceed, you will receive a detailed scope of work and pricing. Payment terms, deliverables, and timelines will be outlined in a separate engagement agreement.

Refund Policy

Refund eligibility depends on the stage of engagement and will be specified in your individual engagement agreement. Work already completed and delivered is non-refundable.

4. Client Responsibilities

As a client of Volution, you agree to:

• Provide accurate and complete information about your professional background
• Participate actively in scheduled sessions and complete agreed-upon tasks
• Respect scheduled appointment times and provide reasonable notice for cancellations
• Not misrepresent your qualifications or experience in materials we help create
• Use AI tools and techniques taught during the engagement ethically and responsibly

5. Intellectual Property

Your Content

You retain ownership of all personal information, career history, and professional materials you provide to us. We claim no intellectual property rights over your content.

Our Materials

Frameworks, methodologies, training materials, templates, and proprietary tools used during our engagement remain the intellectual property of Sintetico Inc. You are granted a personal, non-transferable license to use deliverables created for you during the engagement.

Website Content

All content on volution.app, including text, graphics, logos, and design, is the property of Sintetico Inc. and is protected by applicable intellectual property laws.

6. Confidentiality

We treat all client information as confidential. We will not share your personal details, career situation, or engagement materials with third parties without your explicit consent, except as required by law.

We may use anonymized, non-identifiable information from engagements to improve our services or for general marketing purposes (e.g., anonymized case studies). We will always request permission before using any identifiable information in testimonials or case studies.

7. Disclaimer of Warranties

Volution provides career guidance, repositioning, and AI training services. We do not guarantee specific outcomes, including but not limited to:

• Job placement or employment
• Salary increases or specific compensation levels
• Interview invitations or offers
• Business results from applying AI tools

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. Results depend on individual effort, market conditions, and other factors beyond our control.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Sintetico Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service. In no event shall our aggregate liability exceed the amount you paid for the specific service giving rise to the claim.

9. Indemnification

You agree to indemnify and hold harmless Sintetico Inc., its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the Service, violation of these terms, or infringement of any third-party rights.

10. Termination

Either party may terminate an engagement with written notice, subject to the terms of the individual engagement agreement. Upon termination:

• You will receive all deliverables completed up to the termination date
• Payment is due for all work completed
• We will retain your information as described in our Privacy Policy

11. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of material changes by updating the "Last updated" date on this page. Your continued use of the Service after any changes constitutes acceptance of the new terms.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Any disputes arising from these terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Miami, Florida.
